These Terms and Conditions ("Terms") govern your access to and use of www.bigfootdesigns.net, our online shop, quote tools, customer portal, and related services (collectively, the "Services") offered by Mountain State Designs LLC, doing business as Bigfoot Designs ("Bigfoot Designs," "we," "us," or "our").

By using the Services, requesting a quote, placing an order, uploading artwork, or creating an account, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms, and "you" includes that business.

Bigfoot Designs provides custom screen printing, embroidery, vehicle wraps, signs and banners, decals, branding, and related design and production services, including online ordering and quote requests. Product descriptions, turnaround estimates, and samples on the site are for general information. Final specs, pricing, and timing are confirmed in a quote, proof, invoice, or order confirmation.

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order or create an account. The Services are intended for lawful business and personal use. You agree to provide accurate contact and order information and to keep that information up to date.

Some features may require a customer portal or third-party platform account. You are responsible for safeguarding login credentials and for activity under your account. Notify us promptly at Info@printwv.com if you suspect unauthorized access. We may suspend or terminate access if we reasonably believe the account has been compromised or used in violation of these Terms.

Quotes are estimates based on the information you provide. Prices, taxes, shipping, and fees may change until an order is accepted and paid (or a deposit is received) as stated on the quote or checkout. Online shop prices are generally as displayed at checkout, subject to correction of obvious errors.

An order is not final until we confirm it and any required deposit or payment is received. We may decline or cancel an order for reasons including inventory limits, production capacity, pricing errors, suspected fraud, or artwork that we reasonably refuse under these Terms.

Custom work often requires a deposit. Deposits and payment schedules will be stated on the quote, invoice, or checkout page. Remaining balances may be due before pickup, shipping, or installation as we specify.

You represent and warrant that you own or have all necessary rights, licenses, and permissions to use, reproduce, and authorize us to print, embroider, wrap, or otherwise reproduce any logos, artwork, text, photos, trademarks, or other materials you submit ("Customer Content").

You grant Bigfoot Designs a non-exclusive license to use Customer Content solely to produce, proof, fulfill, and support your order, and to display completed work in our portfolio or marketing unless you tell us in writing not to use a specific project for marketing.

You are responsible for reviewing proofs carefully. Approving a proof (including by email, portal, or written OK) means you accept that the job will be produced as shown, including spelling, colors (subject to material and process limits), layout, and sizing. Color on screens and printers can differ from final printed or wrapped results. We are not responsible for errors you approved on a proof, or for issues caused by low-resolution or unsuitable files you supplied.

We retain ownership of our own designs, templates, processes, and pre-existing materials, except for Customer Content. Unless otherwise agreed in writing, purchase of printed goods does not transfer ownership of our design files or production files beyond what is needed for your completed order.

You may not submit Customer Content or use the Services to:

• Infringe copyrights, trademarks, publicity rights, or other rights
• Promote unlawful activity, or content we reasonably find hateful, harassing, or obscene
• Misrepresent affiliation with a brand, team, or organization you are not authorized to represent
• Attempt to disrupt, scrape, or reverse engineer the site or shop in unauthorized ways
• Upload malware or interfere with other users or our systems

We may refuse, cancel, or remove work that violates this section. Refusal does not waive other rights we may have.

Turnaround times are estimates, not guarantees, unless we agree in writing to a firm deadline. Timing can change due to proof delays, artwork revisions, material availability, weather (for installs), equipment issues, or force majeure events outside our reasonable control.

Changes after proof approval or after production has started may require additional fees and revised timing. Rush fees may apply when you request accelerated production.

Local pickup is available in Belington, WV when arranged. Shipping may be available statewide or nationwide as offered at checkout or on your quote. Shipping dates are estimates. Title and risk of loss for shipped goods pass to you when we deliver the goods to the carrier, unless otherwise required by law or stated in writing.

You are responsible for providing a correct shipping address and for inspecting packages on arrival. Report shipping damage or shortages to us and the carrier promptly (ideally within 5 business days of delivery).

Custom apparel, wraps, signs, decals, and similar made-to-order products generally cannot be returned or refunded once production has begun or a proof has been approved, except for defects in our workmanship or materials under this section.

If you cancel before production starts, we may refund amounts paid minus non-refundable costs already incurred (such as special materials ordered for your job), as we reasonably determine. Deposits may be non-refundable once artwork development or production scheduling has begun, as stated on your quote.

If we produce a defective product due to our error, contact us within 10 business days of pickup or delivery with photos and order details. Our sole obligation for a verified defect is, at our option, to reprint or remake the affected items, repair (where practical), or refund the purchase price of the defective portion. This is your exclusive remedy for defective products under these Terms, to the fullest extent permitted by law.

Stock or non-custom items, if offered, may follow a separate return window stated at purchase. Sale items and opened consumables may be final sale.

You agree to pay all charges at the prices in effect for your order, including applicable taxes and shipping. Payment methods may include card payments processed by Square or other processors used by our shop platform. Chargebacks filed without first contacting us to resolve an issue may result in suspension of future orders and recovery of our costs where permitted by law.

By expressly opting in, you agree to receive customer service, transactional, order-related, and occasional promotional text messages from Bigfoot Designs at the mobile number you provide.

Message frequency varies. Message and data rates may apply. Consent is not a condition of purchasing goods or services. Reply STOP to unsubscribe at any time. Reply HELP for assistance.

After opting out, you may receive one final message confirming that your request was processed. Mobile carriers are not responsible for delayed or undelivered messages. You are responsible for providing an accurate mobile number and notifying Bigfoot Designs if that number changes.

How we handle mobile numbers and SMS consent is also described in our Privacy Policy.

The Services may embed or link to third-party tools (for example, online designers, intake forms, payment pages, or portals hosted by OpsBuilt / OBPrint or other providers). Those tools may have their own terms and privacy policies. We are not responsible for third-party sites or services we do not control, except for our own obligations regarding orders we accept and fulfill.

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE A WARRANTY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.

We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that online colors and previews will exactly match finished goods.

TO THE FULLEST EXTENT PERMITTED BY LAW, BIGFOOT DESIGNS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF AN ORDER OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless Bigfoot Designs and its owners, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Customer Content; (b) your breach of these Terms; (c) your misuse of the Services; or (d) your violation of any law or third-party right.

These Terms are governed by the laws of the State of West Virginia, without regard to conflict of law rules. Except where prohibited by law, you agree that exclusive venue for disputes arising out of these Terms or the Services will be the state or federal courts located in West Virginia, and you consent to personal jurisdiction there.

Before filing a formal dispute, you agree to contact us at Info@printwv.com and attempt in good faith to resolve the issue informally within 30 days.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with any written quote, proof approval, invoice terms, and our Privacy Policy, are the entire agreement between you and us regarding the Services, and supersede prior conflicting discussions on the same subject. We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights without our prior written consent.

We may update these Terms by posting a revised version on this page and updating the effective date. Material changes that affect existing orders will not apply retroactively to those orders unless required by law or agreed by you. For new orders and continued site use after changes take effect, the updated Terms apply.
